Privacy Policy of Gymijet

This privacy policy (“Privacy Policy”) describes the privacy practices of Gymijet LLC (“Gymijet,” “we,” “us,” and “our”) and how we handle information learned about you from your visits to our website available at www.gymijet.com, our [Gymijet] mobile application (the “App”), and all other online applications and digital services operated by Gymijet on which this Privacy Policy is posted (collectively, the “Service”).

PLEASE REVIEW THIS PRIVACY POLICY CAREFULLY. When you access or use the Service or submit information to or through the Service, you accept the terms of this Privacy Policy and our [Terms of Use] (the “Terms”), incorporated by reference herein, and consent to our collection, use, disclosure, and retention of your information as described in this Privacy Policy. If you do not agree to this Privacy Policy, including the Terms, you may not use the Service.

Types of Data Collected

Gymijet may collect, by itself or through third-parties, certain types of personal data for the purposes described below.

Through Access to Third-Party Accounts

The Service may access your data from your account registered on a third-party service and perform actions with it. This is not automatic and requires your explicit authorization. 

Calendar account access (varies by device operating system) – This service allows Gymijet to connect the Service with your account on your device’s calendar app and to read and modify calendar entries. The information collected about you may include your username and/or email address used to sign in to your calendar account and any information you submit to the calendar app (e.g., details about meetings, events, schedules, and other information from calendar entries).

Automatically Collected When You Use the Service

When you access or use the Service, we may automatically collect information about your device, including your device settings and permissions (e.g., permissions to access device camera), technical information automatically logged by our servers, and information collected indirectly from you through our third-party service providers (“Service Providers”) acting pursuant to a separate agreement between the Service Providers and Gymijet.

Cross-Platform Analytics

We may automatically collect information about you through integrated features installed on the Service by our Service Providers, which permit us to deliver the Service to you across different online platforms, and through our analytics Service Providers, which enable us to monitor and analyze web traffic and can be used to keep track of Gymijet users’ behaviors while accessing the Service.

  • Firebase Dynamic Links (Google API) (Google LLC) – Firebase Dynamic Links (Google API) is an integrated app and web browser service provided by Google LLC (“Google”) using App Links (on Android devices) and Universal Links (on iOS devices). Google utilizes the data collected to open the App to a specific webpage or platform or to route users to linked content across the Service. The information collected about you may include device specs and IP addresses. Google may use the data collected to contextualize and personalize the ads of its own advertising network.   • Google Analytics (Universal Analytics) (Google LLC) – Google Analytics (Universal Analytics) is a web analysis service provided by Google. Google utilizes the data collected to track and examine the use of the Service, to prepare reports on its activities and share them with other Google services. Google may use the data collected to contextualize and personalize the ads of its own advertising network. In order to understand Google’s use of data, consult Google's partner policy. The information collected about you may include Trackers and Usage Data. If you would like to opt-out from the use of your information by Google Analytics, you may use Google Analytics’ opt-out browser add-on designed for this purpose.

Tag Management

Tag management helps Gymijet to manage the tags or scripts needed on the Service in a centralized fashion. This results your data flowing through the tag management services, potentially resulting in the retention of this data.

  • Google Tag Manager (Google LLC) – Google Tag Manager is a tag management service provided by Google. The information collected about you may include Trackers and Usage Data.

Information You Provide

Gymijet may collect the information you directly provide to us through the Service.

Collection of Privacy-Related Preferences

The Service may collect and store your preferences related to the collection, use, and processing of your personal data, as requested by the applicable privacy legislation.

  • iubenda Privacy Controls and Cookie Solution (iubenda srl) – The iubenda Privacy Controls and Cookie Solution allows Gymijet to collect and store Service users’ preferences related to the processing of personal data, and in particular to the use of Cookies and other Trackers on the Service. The information collected may include IP address and Trackers. 

Contact Forms and Requests

  • Contact forms on the Service – By filling in and submitting any of the forms on the Service with your personal data, you authorize the Service to use the submitted information to reply to your question or to fulfill your request, including to provide details about products ordered on the Service, updates relating to an account you registered on the Service (“Account”) or subscriptions purchased or applied to an Account, or any other requested communication. The information collected may include your email address, first name, last name, telephone number, and other details you voluntarily submit to us through the contact form. 

  • Online mailing list or newsletter – If you submit your email address to be added to our mailing list for our newsletter, your email address will be added to the contact list of those who may receive email messages containing information of commercial or promotional nature concerning the Service. You may also request to be added to our mailing list by creating an Account or after making a purchase on the Service, in which case the email address associated with the Account or purchase order will be added to our list. The information collected may include email address, first name, last name, phone number, physical address, city, state, country, ZIP/Postal code, and Trackers.

  • Phone contact – If you provide your cellular or telephone number to us, we may use that number to contact you about your Account, as well as to respond to support requests.

Account Registration

By registering for an Account, you agree to allow the Service to identify you and give you access to certain features and dedicated services. To register for an Account, you must provide, and we will collect, your first and last name, mailing address, email address, and telephone number.

Public Profile 

Accountholders may have public profiles that other users can see, which may display the Accountholder’s first name and, if added by the Accountholder, fitness goals and progress tracked on the Service. Other users may also be able to view the reviews or comments submitted by an Accountholder on the Service.

Other User Data 

The Service may collect certain fitness-related data and other information about your exercises, workouts, and physical movements (e.g., repetitions, speed, and form) while using the Service, including motion data collected from photographs and videos you submit to the Service or collected through your camera as described below. This information is used to provide or update personalized workout recommendations, to track your progress, and to improve your overall experience with the Service.

By using the App and granting camera access to the Service, you consent to Gymijet’s collection of your fitness data as described above. You may revoke this permission at any time by adjusting your device settings so that the Service no longer has access to your device’s camera, but doing so may affect the functionality of the App or certain features of the Service. Revoking camera permissions will not automatically delete data previously captured in this manner and collected by Gymijet.

Cookie Policy

The Service uses information collected via tracking technologies such as cookies, web beacons, pixels, embedded scripts, and e-tags (“Trackers”). To learn more, you may consult this Cookie Policy. The data we collect through Trackers and Usage Data is used by Gymijet for our business purposes, including for the operation and improvement of the Service, for technical troubleshooting, to maintain quality of the Service, and to provide general statistics regarding use of the Service.

Data Processing

Security

Gymijet uses reasonable security measures to prevent unauthorized access, disclosure, modification, or unauthorized destruction of the data it collects. However, please note that no data transmission over the Internet or data storage system can be guaranteed to be 100% secure. It is your responsibility to protect the security of your Account login information.

The Purposes of Processing

Gymijet may collect your personal data for the following purposes: 

  • to allow us to provide and improve the Service and our other products and services;

  • to create and manage your Account with us;

  • to operate, improve, and personalize the products and services we offer, and to give each user a more consistent and personalized experience when interacting with us;

  • to personalize our advertising, marketing communications, shopping experiences and promotional offers and to deliver promotions and offers to you that we think may interest you;

  • if you sign up for our email list, to send you emails about products or offers that we think might be of interest to you;

  • for security, to detect fraud or illegal activities, and for archival and backup purposes in connection with the provision of the Service and Service-related products and services;

  • to complete and fulfill your purchase, for example, to process your payments, have your order delivered to you, communicate with you regarding your purchase (including purchased subscription plans), and provide you with related customer service;

  • to communicate with you;

  • for our business purposes, such as data analytics, audits, developing new services and products, enhancing the Service, and identifying Service usage trends; and

  • to comply with our legal obligations, respond to requests from public and government authorities, comply with legal process, enforce this Privacy Policy and our Terms, protect our rights and interests, privacy, safety or property (or those of our Service users, affiliates or other third parties) and allow us to pursue available remedies or limit the damages we may sustain.

Sharing of Data

We may share the data we collect about you:

  • With Third Party Service Providers Performing Services on Our Behalf. We share your personal information with our service providers to perform the functions for which we engage them. For example, we may use third parties to host the Service or assist us in providing functionality on the Service, provide data analytics on the Service, send out emails about the Service and our products, and to process payments.

  • With Independent Contractors and Fitness Expert Consultants. We may share your personal information with independent contractors and fitness expert consultants with whom we engage to provide certain features, such as personalization of users’ workout plans, on the Service.

  • Through Trackers. We may share information collected through Trackers set on the Service with our online analytics service providers.

  • For Legal Purposes. We also may share information that we collect from users as needed to enforce our rights, protect our property, or protect the rights, property, or safety of others, or as needed to support external auditing, compliance, and corporate governance functions. We will disclose personal information as we deem necessary to respond to a subpoena, regulation, binding order of a data protection agency, legal process, governmental request, or other legal or regulatory process. We may also share personal data as required to pursue available remedies or limit damages we may sustain. 

  • Changes of Control. We reserve the right to transfer or assign the information that we have collected from users in connection with a corporate transaction, such as a divestiture, merger, consolidation, or asset sale, or in the unlikely event of bankruptcy.

Links to External Websites and Online Services

The Service may contain links to third-party websites and online services. Any access to and use of such third-party websites or online services is not governed by this Privacy Policy but is instead governed by the privacy policies of those third-party websites or online services, and we are not responsible for the information practices of such third-party websites or online services.

Consent to Receive Communications

You may opt out of receiving promotional emails and newsletters from us by following the unsubscribe instructions provided in any such messages. Please note that if you opt out of our mailing list, this does not impact other transactional and administrative messages which you will continue to receive (such as emails relating to billing and payment information or changes to this Privacy Policy).  

Do Not Track

The Service does not currently take any action when it receives a Do Not Track request. Do Not Track is a privacy preference that you can set in your web browser to indicate that you do not want certain information about your webpage visits collected across websites when you have not interacted with that service on the page. Children 

We do not knowingly collect or maintain personal information from any person under the age of 13. No parts of the Service are directed to or designed to attract anyone under the age of 13. 

Nevada Residents

Under Nevada law, Gymijet does not sell your personal information. However, if you are a Nevada resident, you may submit a request that we not sell any personal information we have collected about you by contacting us as set forth below.

California “Shine the Light” Law

Under California Civil Code Section 1798.83, also known as California’s “Shine the Light” law, California residents with whom we have an established business relationship are entitled to request and receive, free of charge, once per calendar year, information about the customer information we shared, if any, with other businesses for their own direct marketing uses in the previous calendar year. Please be aware that not all information sharing is covered by the “Shine the Light” law requirements and only information on covered sharing will be included in our response.

Changes to this Privacy Policy

Gymijet reserves the right to make changes to this Privacy Policy at any time by posting such updated Privacy Policy on this page and possibly within the Service and/or - as far as technically and legally feasible - sending a notice to you via the email address on file with Gymijet. It is strongly recommended to check this page often, referring to the date of the last modification listed at the bottom.
